Nintendo’s new 3DS will track and record every cartridge you put into it. If you are using a device like an R4 to play illegal copies your DS may be bricked in an update.

Go Nintendo have been pointing to this warning by Japanese retailer Enterking:

“Dear customers who resell Nintendo 3DS
“non purchase able 3DS system”
In case if you use equipment which is illegal or unapproved by Nintendo or if you do customization which is unapproved by Nintendo, there is a possibility that Nintendo 3DS become non bootable by system update.

Because of terms of agreement above, Enterking refuses to buy 3DS system with record of illegal or unapproved equipment.

“Request to format before you sell”

To protect from leaking your personal and internet connection information, We ask customer to format system. In case purchasing could not be established after you format 3DS system, Enterking is not responsible for lost datas and settings. Please understand before you format.”

Considering the 3DS has an always on wireless function, such an update may happen automatically without the knowledge of those with illegal copies.
This in an interesting step but I don’t believe it signifies much in the way of anti-piracy.
Tracking every move you make on a device isn’t new.
Surely you can turn auto-update off, and pirates will probably design a way around it, such as making the DS believe the R4 cartridge is a game cartridge.
Still, definitely interested to see in what ways Nintendo plan to battle piracy on the 3DS.
